Could Compulsory Licensing be a Solution to the Emerging Issues in Health and Human Rights?

The main problem of pandemic diseases as HIV/AIDS, tuberculosis, malaria and so on specially in Sub – Saharan Africa is to get them under control. The principal objective of this project is to study how compulsory licenses can be an useful instrument to govern the diffusion of dangerous diseases (link).

Internet Auctions and Harmonization. A Comparative Perspective.

In this paper the authors Elena Falletti and Hans Peter Wiesemann will describe and analyse Internet auctions with the differences between the “E-marketplaces ”, examine the European directives on E-commerce, consumer protection and distance contracts in relation to Internet auctions and E-marketplaces, focuses the national implementation of European directives, and finally examine the national case law.

The “Kudzu Paradox” in the TRIPS Agreement

My current research topic as described in Max Planck Institut Website.

“The most well- known manifestation of the challenge to fair access to healthy medicines appears in the Declaration on the TRIPS- Agreement and Public Health (Public Health Declaration) adopted in November 2001 as part of the launch of a new round of WTO trade talks in Doha. The Declaration responds to the claim by developing Nations that they are unable to afford the patented pharmaceuticals needed to address the massive HIV/AIDS crisis within their borders. It grants least developed Countries an additional ten years before they must protect pharmaceuticals, and it confirms the principle of balanced intellectual property protection already rooted in diverse clauses of TRIPS. The Public Health Declaration applies only to the narrow, although politically charged, issue of access to patented medicines.

In this context, this research would investigate the present compulsory licensing system in relation to the necessity of public health focusing on the right to life, the right to health and the right to benefit from scientific progress.”

Questo “pezzullo” è stato pubblicato in Brasile, per i tipi della “Revista de Ajuris”, ovvero l’Associazione dei magistrati dello Stato del Rio Grande do Sul. Per me è stato un grande onore venire pubblicata laggiù, dimostra che con Internet davvero non esistono più confini, se non le barriere mentali. Addirittura i magistrati brasiliani mi avevano invitato a tenere una conferenza sul tema dell’amministrazione della giustizia in Italia e in Europa, per ora non mi sono ancora mossa, poi chissà, in futuro….

Conferenza alla Corte di Giustizia

Si tratta di una delle cose cui vado più fiera. Il 24 novembre 2006, a Lussemburgo, mi è stato chiesto di parlare sull’efficacia della diffusione delle decisioni della Corte di giustizia presso i cittadini europei. Tutti conoscono la distanza, a volte anche la diffidenza, che separa cittadini europei dalle istituzioni comunitarie. Scopo della mia relazione era cercare di capire come i motori di ricerca giuridici predisposti dall’Ufficio Pubblicazioni della Corte di Giustizia possano contribuire alla migliore comprensione e diffusione del diritto comunitario.
