Internet Auctions and Harmonization. A Comparative Perspective.

In this paper the authors Elena Falletti and Hans Peter Wiesemann will describe and analyse Internet auctions with the differences between the “E-marketplaces ”, examine the European directives on E-commerce, consumer protection and distance contracts in relation to Internet auctions and E-marketplaces, focuses the national implementation of European directives, and finally examine the national case law.

The “Kudzu Paradox” in the TRIPS Agreement

“The most well- known manifestation of the challenge to fair access to healthy medicines appears in the Declaration on the TRIPS- Agreement and Public Health (Public Health Declaration) adopted in November 2001 as part of the launch of a new round of WTO trade talks in Doha. The Declaration responds to the claim by developing Nations that they are unable to afford the patented pharmaceuticals needed to address the massive HIV/AIDS crisis within their borders. It grants least developed Countries an additional ten years before they must protect pharmaceuticals, and it confirms the principle of balanced intellectual property protection already rooted in diverse clauses of TRIPS. The Public Health Declaration applies only to the narrow, although politically charged, issue of access to patented medicines.

In this context, this research would investigate the present compulsory licensing system in relation to the necessity of public health focusing on the right to life, the right to health and the right to benefit from scientific progress.”

Splog: the dark side of blogging

Il contributo allegato a questo post riguarda il problema dello Splog, cioè l’equivalente “spammaro” della posta elettronica. Molti blog sono “finti” e creati solo esclusivamente a fini commerciali o di marketing. Questo articolo si sofferma sui problemi giuridici che questo fenomeno, ormai dilagante sul web, comporta e sulle eventuali possibiltà di arginarlo.

Weblogs, or blogs, have become an important new way to publish information, engage in discussions and form communities. The increasing popularity of blogs has given rise to search and analysis engines focusing on the “blogosphere”. A key requirement of such systems is to identify blogs as they crawl the Web. While this ensures that only blogs are indexed, blog search engines are also often overwhelmed by spam blogs (splogs). Splogs not only incur computational overheads but also reduce user satisfaction. The aim of the paper is to investigate the juridical problems concerning this topic.

Il danno alla persona nella prospettiva europea

Raccolto all’interno di un più ampio trattato sul “danno alla persona”, (curato da G. Cassano, Edizioni CEDAM, 2006) il contributo intende illustrare come il risarcimento della lesione al “valore uomo” sia inteso dalla giurisprudenza delle Corti sovranazionali e dalla giurisprudenza nazionale dei tre grandi modelli giuridici europei: tedesco, francese e inglese, e attraverso la comparazione, verificare le influenze di tali formanti sulla giurisprudenza italiana.

Nowadays it is interesting to investigate how the international law sources (specifically the European Convention of Human Rights and the European Treaties and Directives) can influence national tort law in Europe, in particular towards the idea of “Europeanisation” of personal injury compensation.  The linked paper reports on this issue.

La tutela della riservatezza individuale e le intercettazioni abusive di massa

Il tema delle intercettazioni abusive di massa, siano esse telefoniche o di messaggi di posta elettronica, è di grande attualità. Negli Stati Uniti il NYT ha scoperto che il Presidente Bush autorizzò segretamente la National Security Agency di intercettare senza alcuna garanzia giudiziaria le conversazioni di cittadini “sospetti”. In Italia, per una serie analoga di episodi, invece, l’ordine arrivò da non si sa bene chi.

Il contributo allegato a questo post analizza l’ordine del giudice distrettuale Anna Diggs Taylor alla National Security Agency di interrompere immediatamente l’abuso. Tuttavia, la questione non è terminata perché, come ci dice Punto Informatico, si tenta depenalizzare il passato, nonostante i gravi abusi commessi. Nel testo vengono altresì analizzati i progetti di legge all’uopo depositati presso la House of Representative, l’evoluzione della class action Hepting v. AT&T insieme ad una breve comparazione della vicenda italiana delle intercettazioni telefoniche abusive. A proposito, che fine ha fatto Echelon?

The attached paper is focused on the U. S.  judicial decision on illegal spying program promoted by National Security Agency (ACLU report) in comparision with the italian case of illegal waretapping programs (EDRI report).

A volte cercare nelle proprie cartelle d’archivio si hanno delle belle sorprese, come queste slides che ho esposto ad una conferenza di Istituto all’ITM di Muenster due anni fa ormai.

Illustravo ai colleghi tedeschi e al Prof. Dr. Thomas Hoeren, direttore dell’Istituto, le peculiarità dello sviluppo del commercio elettronico in Italia. Naturalmente il testo è in tedesco e le slides sono pubblicate sotto licenza creative commons.
